I'm nervous because I'm not a speaker. I don't go to business officers or government officials requesting anything. I know that my proposition is a good one. I hope I can present it correctly.

PLEASE do not go to these caches.
I had a pleasant conversation with the Land Manager today.
She's not the one who rejects proposals. Hope is dim, but there is hope.
I have a meeting with the Director and Land Manager on the 20th. If you'd like to accompany me, let me know.
RE the links provided above: a permit is $500.00 and a $500,000-$1,000,000 insurance policy is required. Do I think this kills it? Probably,
but not necessarily. I asked about a waiver (for a major CITO) or discount.
For whatever reason, DNR does patrol the area, and she got a report from the agent mentioned in one of the logs. She tried to look at the website, but never found the caches listed. Hasn't heard a thing more, until I called this morning.
Attn: Legal Eagles
Does the standard disclaimer on each cache page, or the one I included, have any real weight? Is it enough to argue the insurance is not necessary?
A bunch of you probably have no idea what this is about. Here are my two caches:
Gopher Munitions Plant
The Concrete Forest
Anyone who has been there, anyone who would like the opportunity to go there, anyone who would be willing to participate in a CITO event there:
PLEASE post your thoughts, ideas, etc. here.
Yes, it may appear that I'm trying to protect my two caches. Actually those would be archived because with approval, I have far grander ideas.
I would rank the chance of permissible geocaching, whether it's a one-time CITO event or something on-going, as slightly better than with the DNR.
A slim hope? That's all there is for now.

I know what you saw. I haven't examined that page, and I'm not promoting it.
If it's just a question, I THINK (until I look), that yes, you could. But there might have been a note about non-members must follow the same rules/whatever, which means dress in camo, and bring a bunch of blanks?
Speaking of which, my last trip there I CITO'd a medium shopping bag of brass cartridges from one silo. |

Who knows these days. Unless the cache is placed where you know there are definite hidden hazards (camoflaged pit traps, etc.), or you have done something to make the area dangerous, I would think there is a certain level of assumption of risk involved in any geocaching. If a person sees a cache is in a tree and doesn't wish to risk climbing it, that is their call to make.
However, if some person hurts themselves, an idiot can always sue. I think this is probably true of any cache you place. This does not mean the person will be successful.
Landowners have a little more exposure. When people hurt themselves on other peoples land, they like to sue the landowner. A cache (or an event) would attract people to the site and elevate the landowner's exposure to possible liability. Even a lawsuit that is won by the landowner can be costly. The isurance is probably msotly there to indemnify the landowner to a certain degree. If the landowner is the government, I don't know what the big deal is, as sovereign immunity laws often protect them from negligence suits.
Some will argue waivers and disclaimers of liability aren't worth the paper they are written on. However, they are better than nothing. The safest thing to do if you are trying to set up an assumption of the risk is to fully inform potential seekers of any hazards particular to the location as opposed to a general blanket statement.
This information is not intended as legal advice for any specific situation, but is only a theoretical discourse. In other words, I ain't licensed in Minnesota and I could be wrong anyway. _________________ I am amazed by how many people harp on the need to speak and write English in this country while exhibiting a fundamental lack of skills in the areas of spelling and sentence composition. Would this be irony, hypocrisy, or both? |

I missed the call yesterday, but an appointment is set up with the land manager and the director.
It's show time.

Good luck Ian. Those caches were certainly cool and were GREAT night caches. I would love to see cachers allowed to visit those two incredibly spooky places. _________________ Sad state of affairs. |

The caches have been removed.
The dream is over, what can I say
The dream is over, yesterday
They were the fun ones, but now they are gone
I was the gentle one, but now I must be strong
And so dear friends we'll just have to carry on
The dream is over
The dream is over, no matter what they say
The dream is over, it has to be this way
We played in springtime, but now I play in fall
We hit the bigtime, but now we are small
And our dear friend let's hope he has it all, still
The dream is over
I don't believe in magic
I don't believe in pain
I don't believe in heroes
I don't believe in fame
I don't believe the newsprint
I don't believe we're free
I don't believe in nations
I don't believe in pride
I don't believe in pressure
I don't believe we're right
I don't believe in torture
I don't believe in fight
I don't believe in colour
I don't believe in white
I don't believe in history
I don't believe in being Queen any more
I just believe in me
Just you guys and me
And that's reality
Yes the dream is over
Dream on[/u] |
